These Terms and Conditions apply to all orders placed through the Whitstable Print Ltd website or app. By placing an order, you agree to these Terms and Conditions.
1. About Us
Whitstable Print Ltd ("we", "our" or "us") provides personalised printing services using images and artwork supplied by our customers.
2. Placing an Order
When placing an order, you confirm that: • The information you provide is accurate and complete. • You are authorised to place the order. • You have carefully checked your images, spelling, dates, personalisation and delivery details before submitting your order. Once your order has been paid for, changes or cancellations will not be possible.
3. Your Images
You retain ownership of all images and artwork you upload. By uploading content, you confirm that: • You own the copyright or have permission from the copyright owner to use the image. • You have permission from any identifiable person shown in the image where required. • Where an image includes a child under the age of 18, you are the child's parent or legal guardian, or you have the permission of the child's parent or legal guardian to upload the image and have it printed. • Your images do not infringe any copyright, trademark, privacy or other legal rights. • Your images comply with all applicable laws. You grant Whitstable Print Ltd a non-exclusive, royalty-free licence to use your uploaded images solely for the purpose of producing, quality checking and delivering your order. This licence ends once your order has been completed and any applicable image retention period has expired.
4. Acceptable Content
You must not upload content that: • Is illegal or promotes illegal activity. • Is defamatory, abusive, threatening or discriminatory. • Contains hate speech or material intended to harass or intimidate others. • Infringes copyright or intellectual property rights. • Contains explicit sexual content involving minors or any other illegal material. • Contains sexually explicit content. • Breaches the privacy or rights of another individual. We reserve the right to refuse, suspend or cancel any order that we reasonably believe breaches these terms and conditions, or applicable law.
5. Printing Quality
We print your images as supplied. Printed colours may vary slightly from how they appear on your screen due to differences in monitors, printers and materials. The quality of the finished product depends on the quality and resolution of the images provided. Whitstable Print Ltd cannot accept responsibility for poor print quality resulting from low-resolution or poor-quality images supplied by the customer.
6. Orders, Payment and Pricing
Payment must be received before production begins. Prices shown include VAT where applicable. We reserve the right to correct pricing errors before accepting an order. If this happens, you will be contacted before your order is processed.
7. Delivery
Estimated delivery times are provided as guidance only. We are not responsible for delays caused by Royal Mail, courier companies or circumstances beyond our reasonable control. Risk in the goods passes to you upon delivery.
8. Personalised Products and Returns
As our products are personalised, they cannot usually be cancelled or returned once production has begun. This does not affect your statutory rights. If your order arrives damaged, defective or we have made an error, please contact us within 14 days of delivery and provide photographs where appropriate. We will investigate and, where appropriate, offer a replacement, repair or refund.
9. Image Storage and Security
Uploaded images are treated as confidential. Your images will only be accessed by authorised personnel where necessary to process your order, carry out quality checks or provide customer support. Images will normally be retained for up to 30 days after your order has been dispatched to allow us to deal with customer enquiries or reprints. After this period, they will be securely deleted unless we are legally required to retain them for longer. We take reasonable technical and organisational measures to protect your uploaded images. 10. Customer Responsibility
You are responsible for ensuring that all uploaded content is accurate and that you have obtained all necessary permissions before placing your order. Whitstable Print Ltd is not responsible for errors resulting from incorrect images, spelling, dates or other information supplied by you.
11. Copyright Claims and Indemnity
You agree to indemnify and hold Whitstable Print Ltd harmless against any claims, losses, damages, costs or legal expenses arising from: • Your upload of images or content. • Any infringement of copyright, intellectual property or privacy rights. • Any breach of these Terms and Conditions.
12. Limitation of Liability
Nothing in these Terms excludes or limits liability where it cannot legally be excluded. Subject to this, Whitstable Print Ltd’s total liability in connection with any order shall not exceed the amount paid for that order. We shall not be liable for any indirect or consequential loss, including loss of profits, business or opportunity.
13. Intellectual Property
All branding, logos, website content and designs belonging to Whitstable Print Ltd remain our intellectual property and may not be copied or reproduced without our written permission.
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The latest version will always be available on our website and within our app.
15. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
